New act brings changes to legal parenthood

Same sex couples undergoing fertility treatment will have the right to name both partners on their child's birth certificate from Monday 6 April.

Until now, same-sex partners have been required to formally apply to adopt any child born in a relationship, in order to become a parent.

The Human Fertilisation and Embryology Act 2008 applies to both same-sex and heterosexual couples who conceive using donor sperm or embryos, giving same-sex couples the same rights to parenthood as heterosexual couples when registering their child's birth.

Where couples conceive before 6 April 2009, the second parent will not be automatically recognised and will need to apply to adopt in order to gain legal parenthood
